Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the WinFIT website, mobile application, and related services (collectively, the "Service"). The Service is operated by EG PRIME LLC, with its registered office at 254 Chapman Rd, Ste 208 #25956, Newark, DE 19702, USA ("we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, Refund & Cancellation Policy, Community Guidelines, and Copyright & DMCA Policy (collectively, the "Agreement"). If you do not agree to these Terms, you must not use the Service.
1. Purpose of the Service
WinFIT is a fashion discovery and shopping-assistance service. It helps you identify the individual pieces in an outfit you see — for example in a photo, a screenshot, or a post shared from a social platform — and find matching or similar products to buy, filtered where possible to your size and budget preferences. The Service also lets you save looks and share them.
WinFIT is a discovery and information tool only. It is not a retailer, and it does not sell the products it identifies or links to. Piece identifications, product matches, prices, and availability are provided for convenience, are generated by software, and are not guaranteed to be accurate, complete, or current. WinFIT is not a substitute for professional, legal, financial, or medical advice.
2. What WinFIT Is Not
- Not a retailer or seller. WinFIT identifies pieces and links to third-party stores. All purchases are made directly with those third-party merchants, not with us.
- Not a guarantee of an exact match. Product identifications and "same look" suggestions are generated by software and may be approximate. Labels such as "exact match," "closest look," or "similar" are best-effort estimates, not guarantees.
- Not a guarantee of price, availability, sizing, or outcome. Prices, stock, and merchant details are controlled by the third-party retailer and can change at any time.
- No emergency service. WinFIT does not provide emergency support of any kind.
3. Eligibility and User Account
You must be at least 13 years old (or the minimum age required by the laws of your country) to use the Service. By creating an account, you represent that you meet this age requirement. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.
You must have legal capacity to enter into a binding agreement and comply with applicable laws in your jurisdiction.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. If you suspect unauthorized use, contact us immediately at support@winfitapp.com.
4. Subscriptions, Payments, and Refunds
The Service may be offered on a subscription basis. Subscriptions renew automatically unless canceled before the end of the current billing period.
You may cancel at any time through your account settings or through the platform where the subscription was purchased (for example, Apple App Store or Google Play).
If the Service offers a free trial, you may be converted to a paid subscription at the end of the trial period unless you cancel before the trial ends. Details of any trial offer, including duration and applicable subscription plan, will be presented to you before you enroll.
We may change subscription pricing from time to time. Price changes will take effect at the start of your next billing period following notice of the change. If you do not agree with a price change, you may cancel your subscription before the change takes effect.
Refund rules are described in our Refund & Cancellation Policy. Unless required by law, fees for started billing periods are non-refundable.
5. Acceptable Use
You agree to use the Service lawfully and respectfully. You must not:
- Misuse, disrupt, or interfere with the Service or its infrastructure.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Attempt unauthorized access to any systems or accounts.
- Use the Service for illegal, harmful, abusive, or fraudulent purposes.
- Upload or share content that violates our Community Guidelines.
- Use automated tools, bots, or scrapers to access the Service without our written permission.
- Impersonate another person or entity, or misrepresent your affiliation with any person or entity.
We reserve the right to investigate and take appropriate action against violations, including removing content, suspending accounts, or reporting to law enforcement.
6. User-Generated Content
The Service allows you to submit and share content including outfit photos and screenshots you scan, saved looks, profile information, and anything you choose to share with others through the Service (collectively, "User Content").
Ownership. You retain ownership of your User Content. However, by submitting User Content to the Service, you grant EG PRIME LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and create derivative works from your User Content solely in connection with operating, providing, and improving the Service. This license ends when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it.
Your Responsibility. You represent and warrant that you own or have the necessary rights to your User Content, and that it does not infringe upon any third party's intellectual property, privacy, or other rights. You are solely responsible for the content you upload and share.
Content Visibility. Content you choose to share through the Service (for example, a look you send to another person) may be visible to the people you share it with. Please consider carefully before sharing.
Moderation. We reserve the right, but have no obligation, to review, edit, or remove any User Content at our discretion, including content that violates these Terms or our Community Guidelines. For copyright-related takedown requests, please see our Copyright & DMCA Policy.
7. AI-Powered Features and Third-Party Processing
WinFIT uses artificial intelligence and automated search to analyze the outfits you submit, identify the pieces in them, and find matching or similar products. By using these features, you understand and agree that:
- The images you submit, and cropped regions of individual pieces, may be transmitted to third-party AI and product-search providers (which currently include OpenAI, Anthropic, and image- and web-based product-search providers) to identify pieces and find matching products. These providers process your data according to their own privacy and data policies.
- Piece identifications, product matches, prices, and "same look" suggestions are generated automatically and may not be accurate, complete, or suitable for your situation. They are provided for informational purposes only.
- WinFIT does not extract or store biometric identifiers (such as facial geometry or body measurements) from your photos. Images are used solely to identify clothing and find matching products.
- We do not guarantee the availability, accuracy, or consistency of automated outputs. Models and providers may change over time.
8. Intellectual Property
All software, content, branding, and materials available through the Service (excluding User Content) are owned by EG PRIME LLC or its licensors and are protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use of the Service, subject to these Terms.
9. Data and Privacy
We collect and process personal data in accordance with our Privacy Policy. By using the Service, you acknowledge and agree to those data practices.
10. Third-Party Services, Retailers, and Affiliate Links
The Service relies on third-party services including, but not limited to, cloud hosting, AI and product-search processing, analytics, payment processing, and push notification delivery. We are not responsible for the availability, performance, or policies of these third-party services.
Third-Party Retailers and Affiliate Links. The Service links to products sold by third-party retailers. Some of these links are affiliate links, which means we may earn a commission if you make a qualifying purchase — at no additional cost to you. We do not sell these products, do not process their payments, and are not responsible for the products, prices, availability, quality, shipping, returns, or any transaction between you and a third-party retailer. Any purchase you make from a linked retailer is governed solely by that retailer's own terms and policies.
Your use of the Service is also subject to any applicable third-party terms (such as Apple App Store or Google Play terms).
11. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted availability, absolute accuracy, or specific outcomes.
To the maximum extent permitted by law, the total liability of EG PRIME LLC and its officers, directors, employees, and agents for any claim related to the Service is limited to the amount paid by you for the Service during the three (3) months preceding the event giving rise to the claim.
In no event shall EG PRIME LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of the Service.
12. Indemnification
You agree to indemnify, defend, and hold harmless EG PRIME LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any rights of another person or entity.
13. Dispute Resolution
Informal Resolution. Before filing any formal legal action, you agree to first contact us at support@winfitapp.com and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration. If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Delaware, USA, or at another mutually agreed location. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found to be unenforceable, the entirety of this arbitration provision shall be null and void.
Exceptions. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Claims eligible for small claims court may also be brought there.
European Union Residents. If you reside in the EU, this arbitration clause does not affect your right to bring claims before the courts of your country of residence under applicable consumer protection law. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
14. Account Deletion
You may request deletion of your account at any time by contacting support@winfitapp.com or through the in-app settings. Upon deletion:
- Your profile, posts, comments, and personal data will be permanently removed.
- Content you shared with others may remain visible to the people you shared it with.
- Active subscriptions are not automatically canceled; you must cancel separately through your app store.
- Deletion is irreversible. We cannot recover your account or data after deletion.
We will process account deletion requests within 30 days, subject to any legal retention obligations.
15. Termination
You may stop using the Service at any time. We may suspend or terminate your access if these Terms are violated, if required by law, or if the Service is discontinued.
Upon termination, the following sections survive: User-Generated Content (Section 6), Disclaimers and Limitation of Liability (Section 11), Indemnification (Section 12), Dispute Resolution (Section 13), and Governing Law (Section 16).
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles.
Subject to the arbitration provision above, any legal action not subject to arbitration shall be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and may notify you by email or in-app notification. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree with any changes, you should stop using the Service.
18. General Provisions
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement. These Terms, together with the Privacy Policy, Refund & Cancellation Policy, Community Guidelines, and Copyright & DMCA Policy, constitute the entire agreement between you and EG PRIME LLC regarding the Service.
Waiver. The failure of EG PRIME LLC to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
Force Majeure. EG PRIME LLC shall not be liable for any failure or delay in performing obligations due to causes beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet disruptions, or third-party service outages.
